Terms & Conditions of Sale
These Terms & Conditions of Sale (‘Terms’) apply to all purchases from JFS NE Ltd trading as Furniture North East (‘we’, ‘our’, ‘us’). By placing an order via our website, email, telephone, or showroom, you agree to these Terms. If you do not accept these Terms, please do not place an order.
1. Definitions
‘Stock Products’ – Standard items available from stock, returnable under conditions in Section 5.
• ‘Bespoke Products’ – Custom or made-to-order items where finishes, fabrics, sizes, or other specifications are chosen by you.
• ‘Customer’ – The purchaser placing the order.
• ‘Contract’ – A legally binding agreement formed once we confirm your order.
2. Scope
These Terms cover:
• Online purchases via www.furniturenortheast.co.uk
• Orders placed by email or telephone
• Showroom and trade sales
• Pro forma and invoiced transactions
3. Sales Promotions & Special Buys
From time to time, we may offer time-limited promotions or specially negotiated prices (‘Special Buys’). These may not represent discounts from previous pricing but negotiated supplier rates. Orders linked to promotions are governed by these Terms in full.
4. Images, Colours & Sizing
Product images are for illustrative purposes only. We cannot guarantee exact colour reproduction due to display differences.
• Wood, fabrics, and metal finishes may vary due to natural variations.
• All sizes, weights, and dimensions are approximate and may vary slightly.
5. Prices & Errors
Prices are shown excluding VAT and delivery unless otherwise stated.
• If a pricing error is obvious and could reasonably have been recognised, we are not obliged to supply the product at that price.
• We reserve the right to cancel or amend orders where errors occur and will notify you before dispatch.
6. Payment Terms
Orders under £5,000: Full payment required at order.
• Orders £5,000 or above: 60% deposit required, balance payable before dispatch.
• Higher deposits may be requested depending on the order.
• No credit accounts offered.
• Ownership remains with us until full payment has cleared
•In the event the agreed delivery date is delayed by the Customer, We reserve the right to request full payment for the balance if the order.
7. Stock Products – Returns & Refunds
Returns accepted within 7 days of delivery for unused items in original packaging.
• A 20% restocking fee applies unless agreed otherwise in writing.
• Customer responsible for return costs and goods-in-transit insurance.
• Refunds processed within 14 working days after inspection.
• Returns not accepted where:
– More than 7 days have passed
– Packaging discarded
– Items used or assembled
– Items damaged or not resaleable
8. Bespoke & Made-to-Order Products
Bespoke products are strictly non-returnable and non-refundable once production begins.
• If cancellation occurs before production, we may deduct non-recoverable costs such as fabrics, components, and labour.
• Large projects may require written design and finish approval before work starts.
• By ordering bespoke items, you accept that statutory cancellation rights do not apply.
9. Delivery & Risk
Delivery dates provided are estimates only and cannot be guaranteed.
• UK mainland deliveries only unless otherwise agreed.
• You must check goods on delivery and report damages or shortages within 24 hours, with supporting photos.
• After three failed delivery attempts, we may treat the contract as cancelled and deduct costs incurred.
• Risk transfers to you on delivery, but ownership remains with us until paid in full.
10. Damages & Claims
Goods must be inspected on delivery.
• Any damages or shortages must be reported in writing within 24 hours of receipt including supporting images.
• Claims outside this timeframe may not be processed.
11. Warranties
All products are covered by the manufacturer’s warranty only.
• Designed for commercial use; no guarantee for residential suitability.
• Warranty claims cover manufacturing defects only, not misuse, wear and tear, or incorrect installation.
12. Liability
Our liability is limited to the price you paid.
• We are not liable for indirect, incidental, or consequential losses, including business interruption or lost profits.
13. Force Majeure
We are not liable for delays or failures due to events beyond our reasonable control, including supplier delays, transport issues, global disruptions, natural disasters, and unforeseen manufacturing problems.
14. Consumer Rights (B2C Orders Only)
If you are purchasing as a private individual online, your rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 apply unless:
• The order is for bespoke or made-to-order items
• The goods have been used or assembled.
15. Dispute Resolution & Governing Law
Please contact [email protected] in the first instance to resolve disputes.
• If unresolved, mediation will be attempted before legal action.
• These Terms are governed by English law and under the jurisdiction of English courts.
• Scottish and Northern Irish residents may alternatively bring claims in their local courts.
